These Terms of Service (the “Terms”) govern your use of the website operated by FRIENDS OF CORRIE KRING (“Company,” “we,” “us,” “our”). By accessing or using this site or participating in our text messaging program, you agree to these Terms. If you do not agree, do not use the site and do not enroll in our messaging program.

1. Website Purpose

This website provides general information about our organization and an option to receive SMS or MMS messages. We do not sell products or services through the site. Nothing on the site is a binding offer. Any informational content is provided for convenience only.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the site or enroll in our messaging program. By using the site or enrolling, you represent that you meet this requirement.

3. Messaging Program Description (10DLC)

We offer an A2P 10DLC messaging program (“Program”) to deliver informational or promotional text messages. Message types may include election and civic information, reminders, event updates, or similar content. By opting in, you consent to receive SMS or MMS messages from us at the mobile number you provide. Participation is not a condition of any purchase.

Message frequency: Up to 4 messages per month.
Message content: You will receive SMS notifications about Corrie Kring's campaign for the current election cycle.

4. Opt In Consent

You may opt in by submitting your mobile number through a compliant web form, by texting a keyword to our designated long code, or by other methods we clearly disclose. By opting in, you affirm that you are the subscriber or customary user of the number provided and that you agree to receive messages as described. You agree that we may use an automated system to send messages to the number you provide.

5. Opt Out and Revocation of Consent

You can opt out at any time by texting STOP to our sending number. After you send STOP, you will receive a one time confirmation text, then you will no longer receive messages from us, unless you opt in again by texting START or by re enrolling through another disclosed method. You can also request removal by contacting us at [email protected]. Your opt out revokes consent for future messages and will be honored within a reasonable time.

Supported keywords: STOP, END, CANCEL, UNSUBSCRIBE, QUIT, and START to re opt in.

6. Help

For help, text HELP or contact us at [email protected]. When you text HELP we will reply with contact information and instructions on how to opt out.

7. Fees and Charges

Message and data rates may apply. You are responsible for any charges from your wireless carrier. Carriers are not liable for delayed or undelivered messages.

8. Delivery and Carrier Disclaimers

Delivery is subject to effective transmission from your carrier or network operator. We do not guarantee message delivery, timeliness, or availability. Wireless carriers are not liable for delayed or undelivered messages.

9. Privacy

Please review our Privacy Policy, which explains how we collect, use, and retain personal data, including mobile numbers and consent records. By using the site or the Program, you agree to the Privacy Policy. We will maintain consent and opt out records for compliance, we may share limited information with service providers and carriers for Program operation, and we will not sell your mobile number.

10. Prohibited Content and Use

You agree not to use the site or Program for unlawful, harmful, or abusive purposes, including content that is illegal, deceptive, threatening, harassing, hateful, or that involves prohibited categories under carrier, CTIA, or 10DLC rules, for example controlled substances, illegal gambling, sex related content, or other restricted content. We may suspend or terminate access if we believe you have violated these Terms or applicable rules.

11. User Representations

You represent that you own or control the mobile number you use to opt in and that you will notify us promptly if the number changes or is reassigned. You agree that you will not enroll a number that does not belong to you.

12. Intellectual Property

All text, graphics, logos, and other materials on the site are owned by us or our licensors and are protected by law. You may not copy, distribute, or create derivative works without our prior written permission.

13. Disclaimer of Warranties

The site and Program are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non infringement.

14. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from or related to the site or the Program, even if we have been advised of the possibility of such damages. Our total liability for any claim will not exceed one hundred dollars, or the amount you paid to us in the past six months, whichever is greater.

15. Indemnification

You agree to indemnify, defend, and hold harmless Company, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the site or the Program, your violation of these Terms, or your violation of any rights of another.

16. Dispute Resolution and Arbitration

Any dispute arising from or relating to these Terms, the site, or the Program will be resolved by binding arbitration on an individual basis, not in a class or representative action. The arbitration will take place in Chesapeake, VA, unless the parties agree otherwise. You and we waive any right to a jury trial. This section does not prevent either party from seeking injunctive relief in court.

17. Changes to the Program or Terms

We may modify or discontinue the site or Program, or update these Terms, at any time. If we make material changes, we will post the updated Terms and update the effective date above. Your continued use of the site or participation in the Program after changes become effective constitutes acceptance of the updated Terms.

18. Termination

We may suspend or terminate your access to the site or Program at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to users, us, or third parties.

21. Entire Agreement

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the site and the Program and supersede any prior or contemporaneous understandings.
